Interview and Interrogation Law (Online)

Interviews and interrogations often play important roles in criminal investigations. The collection of relevant information, development or elimination of suspects and many other pieces of the puzzle can be obtained through effective interview and interrogation techniques. In order for the information collected to be admissible in a court of law, it must be legally obtained. This course will provide a comprehensive legal review of the case law and statutes governing interviews and interrogations.

Course Objectives

Understand the constitutional amendments governing interviews and interrogations.

Distinguish between "attachment" and "invocation" of rights.

Distinguish between Fifth and Sixth Amendment interrogation rights.

Understand North Carolina's interrogation rules.

Comprehend interrogation practices which are allowed and prohibited by Fourteenth Amendment Due Process Clause.

Apply the special rules concerning interrogation of juveniles.

Understand the meaning of interrogation rights waivers and how officers are to obtain such waivers.

Understand the exceptions to the Miranda rule.

Understand when an interrogation may be re-commenced after an invocation of rights.

Distinguish between a voluntary encounter and an interrogation.
